Topic:  6^th ADDITION TO THE COBBLER MOUNTAIN AGRICULTURAL AND FORESTAL DISTRICT 

Topic Description:

This is a request by Thomas and Patricia Fabyanic to add approximately 28.172 acres to the Cobbler Mountain Agricultural and Forestal District that will expire on March 6, 2006. 

The Planning Commission considered the request on April 25, 2002.  No one spoke in favor of, or in opposition to, the request. 

The Planning Commission voted (5-0) to forward the request to the Board of Supervisors with a recommendation of approval.  Additional background is provided in the attached staff report.

Requested Action of the Board of Supervisors: 

Hold a public hearing and take action as deemed appropriate.  Should the Board move to approve this request, a proposed Ordinance is attached. 

Financial Impacts Analysis:

The Code of Virginia Article 15.4312 Effects of districts - A.  This section states that “land lying within a district and used in agricultural or forestal production shall automatically qualify for an agricultural and forestal use-value pursuant to Article 4 of Chapter 32 of Title 58.1 if the requirements for such assessment contained therein are satisfied.” 

This property is currently in land use taxation.
