Topic Description: |
|
Due to overcrowding and
diminished capacity, the
Clarke-Fauquier-Frederick-Winchester Regional Adult
Detention Center (herein referred to as “The Regional Jail”)
is seeking to develop, design and construct a work release
facility. In March 2004, The Regional Jail submitted a
Community-Based Corrections Plan to the Virginia Department
of Corrections to request reimbursement of up to one-half of
the pro rata share of capital costs to each participating
locality. Now, the Regional Jail is submitting a draft of a
Comprehensive Agreement by and between Howard Shockey and
Sons, Inc. and the City of Winchester (the Regional Jail’s
fiscal agent) to each participating locality for approval.
This Agreement has been reviewed by both the County
Attorney’s Office for legality of form, and by the County
Budget Office for fiscal implications. |

attached resolution. (The
agreement referred to in this resolution is not available
electronically and is available in the Board of Supervisor’s
Office for review.) |

Financial Impacts Analysis: |
|
Approval of the agreement
obligates the participating localities to compensate the
designer-builder on a pro rata basis for all executed work
and expenses if the project is terminated prior to start of
construction. The maximum projected
impact to Fauquier County, if this termination should occur,
is estimated to be approximately $171,136 payable sometime
in FY 2005.
There will be no land acquisition or site work until
construction documents are 100% complete and the Jail Board
and participating localities approve the final project.
The estimated annual cost to Fauquier County, if this
project is completed, would be approximately $150,000 for 20
years beginning in FY 2006. This amount does not reflect the
State’s commitment to reimburse 50 per cent of the costs. If
this occurs Fauquier County’s cost would be $75,000.
