A Resolution to Abandon a Portion of Cedar Run Drive in Fauquier County

Topic Description:

On March 15, 2004, the Board of Supervisors held a public hearing on a request to abandon a portion of Cedar Run Drive, which is not currently in the State Secondary System of Highways.  At that time, the Board of Supervisors decided to continue with the abandonment process.  This is the next step in the process.  The required public notice has been made, which permits requests for a public hearing.  As of the preparation of this report, no petitions have been received for a public hearing.


The street was dedicated to public use with Phase Two of the Millwood Subdivision Plat dated November 1979, and recorded in deed book 409 at page 583 among the Fauquier County land records.  Sixty (60) feet of right-of-way was dedicated with the plat to provide for a future connection to Route 678.  However, a temporary cul-de-sac was put in place rather than a full connection to Route 678.  The portion of the street to be abandoned has never been improved and used as a street.  Additionally, this portion of Cedar Run Drive was never taken into the State Secondary System of roads.


The Transportation Committee has recommended that the Board consider directing the County Administrator to no longer pursue the abandonment of this section of right-of-way, and not to seek establishment of a permanent cul-de-sac in this location.  The Virginia Department of Transportation (VDOT) has recommended that the right-of-way remain available to provide options for future development of road connections.


Requested Action of the Board of Supervisors:

Consider adoption of the attached resolution.


Transportation Committee Recommendation:

On January 28, 2004, the Transportation Committee recommended that the Board of Supervisors consider retaining the Cedar Run Drive right-of-way, and not institute the abandonment process
