RESOLUTION 

A Resolution to DENY comprehensive plan amendment CPAM05-CT-006 TO Include Additional Land in the Warrenton Service District

              WHEREAS, Constance Clyde and Lisa Nielsen, Clyde Family Trustees, and Premier at Cedar Mill LLC, Owners, and Premier at Cedar Mill LLC, Applicant, have requested a Comprehensive Plan Amendment CPAM05-CT-006 to include additional land in the Warrenton Service District on the property identified by PINs 6994-36-7932-000,  6994-26-8780-000, 6994-37-4250-000, 6994-27-7561-00000; and

 

WHEREAS, the requested application for the Comprehensive Plan Amendment would allow for the inclusion of the aforementioned properties in the Warrenton Service District and allow for extension of public water to serve the properties; and

 

WHEREAS, on May 26, 2005, the Planning Commission held a public hearing on the application and voted to recommend denial of the Comprehensive Plan Amendment as the proposal is not consistent with the Comprehensive Plan; and

 

            WHEREAS, on July 14, 2005, the Fauquier County Board of Supervisors conducted a public hearing and considered the written and oral testimony; and

WHEREAS, the Fauquier County Board of Supervisors concurred with the judgment of the Planning Commission and finds that the Comprehensive Plan Amendment is not warranted for this request; now, therefore, be it

            RESOLVED by the Fauquier County Board of Supervisors this 14th day of July 2005, That Comprehensive Plan Amendment CPAM05-CT-006, Constance Clyde and Lisa Nielsen; Clyde Family Trustees; and Premier at Cedar Mill LLC; Owners, and Premier at Cedar Mill LLC, Applicant, be, and is hereby, denied; and, be it

 

RESOLVED FURTHER, That the provision of public water to these properties is inconsistent with the Comprehensive Plan.
