A Resolution Authorizing the County Administrator to Execute an Agreement with the Commonwealth Transportation Commissioner for Enforcement of Virginia Code Section 33.1-374 Pertaining to Illegal Signs in the Right-of-Way

Topic Description:

This resolution will allow the County to enter into an agreement with the Commonwealth Transportation Commissioner. Under the agreement, County employees will act as agents of the Virginia Department of Transportation (VDOT) and be allowed to remove signs from the right-of-ways.

Requested Action of the Board of Supervisors:

Consider adoption of the attached resolution.

Summary Staff Report:

Signs posted in the right-of-ways violate State and County law.

At its work session in May 2005, the Board of Supervisors directed the Zoning Office to put together a program to eliminate illegal sign posting in the right-of-ways. The Virginia Department of Transportation, by statue, is authorized to enter into agreements with localities for the abatement of illegal signs in the right-of-way. Under such an agreement, county officers act as agents of VDOT in sign removals. The County Attorney recommended entering into such an agreement.

Upon execution of the agreement, a letter will be sent to all realtors reminding them that posting in the right-of-way is illegal. Approximately one week thereafter, sign removal will begin.
