The
County of Fauquier, by previous resolution, has authorized Midland
Development Corporation to construct and operate a T-hangar
located at the Warrenton-Fauquier Airport.
A copy of the area
leased to Midland Development Corporation is attached to this
Agenda Request. As
part of obtaining
financing for this project, the lender requires that Midland
Development Corporation and the County of Fauquier execute an
Owner's Affidavit stating that there are no existing mechanic's
liens, or other adverse or outstanding matters affecting title to
the area to be leased to Midland Development Corporation; and,
that the Landlord consents to Midland Development Corporation's
assignment of its lease to BB&T Bank as security for its loan
to Midland Development Corporation. The attached resolution
authorizes the Assistant County Administrator to execute the Owner's
Affidavit and the Landlord's
Consent & Borrower's Assignment of Lease subject to
approval as to form by the County Attorney.
