On
March 13, 2002, Dominion Virginia Power submitted a request to be
relieved from its obligation under Condition number 3 of a Final
Order adopted by the Board of Supervisors on November 5, 2001. The
Final Order related to Dominion Virginia's proposal to acquire
additional right-of-way in the Southern Fauquier Agricultural and
Forestal District in order to construct a new 34.5 kv power line
adjacent to an existing power line. The Final Order provided, in
pertinent part:
"Should
the governing body of any other jurisdiction approving a portion
of this electric line project require a less impactive method of
constructing the 34.5 kv electric feeder line, such construction
shall also be used in this agricultural-forestal district.
Dominion Virginia Power shall have the right to apply to the Board
of Supervisors to be relieved from the obligations of this
condition upon a showing that the less impactive method imposed in
the other jurisdiction will not result in a lessening of the
impact in this jurisdiction or would be uneconomical or
impractical, which decision shall be at the sole discretion of the
Board of Supervisors."
