PUBLIC HEARING AGENDA REQUEST
Board of Supervisors
Paul S. McCulla
An Ordinance to Amend Section 16-7 of the Code of the County of Fauquier by Adding Subsection (d) to Allow Certain Persons to Carry Concealed Handguns in County Parks
Section 16-7 of the Fauquier County Code prohibits the carrying of weapons in a County park. The Virginia General Assembly has amended the Code of Virginia to restrict the ability of local governments to regulate the carrying, possession and transportation of firearms. In so doing, the Virginia General Assembly, however, grandfathered existing Ordinances. Fauquier County Code provisions come under the grandfathering rules. Since that time, the General Assembly has also amended its Code to prohibit Commonwealth’s Attorneys from prosecuting persons with concealed weapons when they are carrying concealed weapons in parks pursuant to a validly issued permit. On June 16, this matter came before the Board for consideration and a resolution authorizing the public hearing was adopted. The public hearing was scheduled for the Board’s July meeting.
