Topic:  An Ordinance to Approve the 3rd Renewal of the Upperville Agricultural and Forestal District Within Fauquier County

 

Topic Description:  

This is a request to renew the Upperville Agricultural and Forestal District for another eight-year term.  Without this renewal, the district will expire on November 8, 2003 , affecting 99 parcels and encompassing 6,872 acres in northern Fauquier County . 

On March 10, 2003, the Agricultural and Forestal Advisory Committee reviewed this renewal and made the following recommendation:  (1) include all parcels which are currently enrolled in the District and which are greater in size than twenty-five (25) acres; and (2) remove all of those parcels in the District which are smaller in size than twenty-five (25) acres unless the owner(s) submit a written statement verifying that the parcel in question is under the same ownership as other parcels in the District which are being renewed and are part of the working farm, or are under an open space easement.  This recommendation is based on a Board of Supervisors’ policy adopted on March 6, 1990 .  The listings of all of the affected parcels are found in the attached staff report.  

On April 24, 2003 , the Planning Commission held a public hearing and voted to adopt the Agricultural and Forestal District Advisory Committee’s recommendation as stated above.

Requested Action of the Board of Supervisors: 

Hold a public hearing and take action as deemed appropriate.  Should the Board move to approve this request, an Ordinance is included. 

 

Financial Impacts Analysis:

The Code of Virginia Article 15.2 A., Effects of districts, states that “land lying within a district and used in agricultural or forestal production shall automatically qualify for an agricultural and forestal use-value pursuant to Article 4 of Chapter 32 of Title 58.1 if the requirements for such assessment contained therein are satisfied.”
