Topic
Description:
On August 10, 2006, the Board of Supervisors approved a
Special Exception and Comprehensive Plan Conformance
Determination (CCRV06-LE-004)
to construct a water tank within the Remington
Service District. The Special Exception was approved
subject to a series of development conditions. However, due
to unforeseen circumstances, the applicant has not been able
to start construction on the water tower. Per Zoning
Ordinance Section 5-014, if a use or construction has not
commenced within one year from approval of the Special
Exception that it shall expire. Pursuant to Section 5-014,
the applicant requests a three (3) year extension from the
Board of Supervisors.

With the exception of public uses, whenever an
administrative permit, special permit or special exception
is issued by the Zoning Administrator, BZA or Board, the
activity authorized thereby shall be established and
construction authorized shall be diligently pursued within
such time as the permit specified or, if no such time has
been specified, then within one (1) year after the effective
date of such permit or exception. If the use or construction
has not commenced within a period of one (1) year, such
administrative permit, special permit or special exception
shall automatically expire without notice. The BZA or Board
may grant an extension to a special permit and special
exception because of the occurrence of conditions unforeseen
at the time of granting the special permit or special
exception, upon application by the original permitee for
such extension.
The
applicant has indicated that they have been diligently
pursuing construction and site plan approval for the water
tank, but need additional time to accomplish these items.
Staff has been provided with the status of work from the
applicant’s engineer. (See attachment 1).
Further, the
basis for the extension is that the exact location of the
elevated water tower lot is dependent on the exact lot
layout of the Revere Woods subdivision (since the water
tower lot overlaps onto the Revere Woods site). The Revere
Woods site plan has been submitted but is currently being
revised to address comments. Revere Woods has been working
on lot line adjustments due to changes to the stormwater
management pond configuration. Design work for the tank has
been done in coordination with Fauquier County Water and
Sanitation Authority (WSA) related to the tank size, height,
hydraulic calculations, pump design, soil borings, and
footer design. However, the site plan for the elevated
water tank cannot be completed and submitted until the
Revere Woods subdivision construction plans and record plats
are approved.
