A Resolution to Approve a Modification to Section 9-11 of the Subdivision Ordinance to Extend the Validity of the Cedar Mill Preliminary Plat (WVRP08-CT-015), CENTER DISTRICT

            WHEREAS, RFI CM, LC, owner, is seeking a waiver of Subdivision Ordinance Section 9-11 to allow a Preliminary Plat to remain active for a longer period of time; and


            WHEREAS, Cedar Mill subdivision was originally approved on July 13, 2006; and

            WHEREAS, two extensions have been granted, keeping this subdivision active until January 13, 2009; and           

            WHEREAS, the properties that make up the proposed subdivision are under new ownership; and

            WHEREAS, the new owner is interested in developing the Cedar Mill subdivision under the current Conditions of Development which include a Developerís Agreement to construct significant road improvements; and


            WHEREAS, on July 31, 2008 the Fauquier County Planning Commission recommended approval of the proposed Subdivision Ordinance waiver; now, therefore, be it


            RESOLVED by the Fauquier County Board of Supervisors this 14th day of August 2008, That Subdivision Ordinance Section 9-11 be, and is hereby, waived to allow the Cedar Mill   Preliminary Plat to remain active until January 13, 2011, before which time a Record Plat shall be filed with the Department of Community Development.
