RESOLUTION 

A Resolution to DENY SPECIAL EXCEPTION SPEX04-MA-020, a Category 20 Special Exception to Allow CONSTRUCTION OF AN ABOVE GROUND WATER STORAGE SILO

            WHEREAS, the owners of the property, identified by PIN 6969-47-7043-000, have requested a Category 20 Special Exception to allow for the construction of an above ground water storage silo; and

WHEREAS, the requested Special Exception would allow the applicants to construct a water storage silo on the proposed site within the Cannon Ridge subdivision’s dedicated open space; and

            WHEREAS, on April 29, 2004, the Planning Commission voted unanimously to recommend denial of the Special Exception SPEX04-MA-020 to the Board of Supervisors for the following reasons:

1.      The proposal for the Special Exception is not consistent with the Fauquier County Comprehensive Plan.

 

  1. The proposal fails to satisfy the general and specific standards for the proposed use established by the Fauquier County Zoning Ordinance.

 

  1. The proposal can not move forward as the proposed site is within the dedicated open space of the Cannon Ridge subdivision, which has already been reduced by an approved Special Exception SPEX03-MA-016.  Open space credit cannot be afforded to lands which include the proposed public facility unless a Special Exception amendment, for further reduction of open space, is approved.

 

  1. The proposal failed to demonstrate that there were no other alternatives available, nor did it show that any other options were pursued and then eliminated due to cost, location, or other reason.

WHEREAS, on June 21, 2004 and July 19, 2004, the Fauquier County Board of Supervisors held public hearings and considered the Special Exception application; and

WHEREAS, on August 16, 2004, the Fauquier County Board of Supervisors continued that public hearing and concurred with the judgment of the Planning Commission; now, therefore, be it

            RESOLVED by the Fauquier County Board of Supervisors this 16th day of August 2004, That Special Exception SPEX04-MA-020, Douglas E. & Sharon Y. Darling, Owners/Applicants, be, and is hereby, denied.
