This
proposed Zoning Ordinance text amendment would permit farm
equipment sales, rental and service as a land use in the Rural
Residential-2 (RR-2) Zoning Districts with special permit approval
from the Fauquier County Board of Zoning Appeals.
Site plan approval also would be necessary.
The
Planning Commission conducted a public hearing on this proposal on
July 25, 2002 and forwarded the text amendment to the Board of
Supervisors with a recommendation of approval.
The Board of Supervisors had forwarded the referenced text
amendment on June 17, 2002 to the Planning Commission for a public
hearing and its recommendations.
The
Zoning Ordinance currently permits the location of farm equipment
sales, rental and service in the Rural Agriculture (RA) Zoning
Districts after receiving special permit approval from the Board
of Zoning Appeals and obtaining site plan approval.
The Zoning Ordinance includes the Rural Residential-2
(RR-2) Zoning Districts in the rural zoning district category, but
this use currently is not permitted in the RR-2 districts.
The
Zoning Ordinance also currently permits farm equipment sales,
rental and service establishments as a by-right use in the
Commercial-2 and Industrial-1 Zoning Districts and as a special
permit use in the Commercial-1, Commercial Village and
Industrial-2 Zoning Districts.
A site plan is required in all districts.
Almost
all of the RR-2 Zoning Districts lie within Lee and Cedar Run
Magisterial Districts. This
added special permit provides the Board of Zoning Appeals with the
oversight and the ability to establish conditions to mitigate any
identified impacts. The BZA oversight will help to ensure proper
examination of each application with regard to location, traffic,
noise, screening and other criteria.
Site plan approval would be mandated.
The
additional standards for farm equipment sales, rental and service
establishments are identical to those for automobile sales, rental
and service establishments. The
farm sales, rental and service establishments also have an
additional standard prohibiting parking, loading, storage and
display in any required front yard or within 50 feet of the side
and rear yard lot lines. Both
sets of standards are included.
