Topic
Description:
The
applicant wishes to rezone approximately 165.0 acres from
Residential (R-1) conditional to Residential R-1 and R-2
with proffers to allow for: 1) a clustered residential
subdivision with an affordable housing component; 2) one
conventional lot; and 3) one non-common open space parcel.
Based on
recent meetings and discussions with the applicant, staff
anticipates receipt of revised proffers that will further
clarify the proposal. The proposal includes fifteen (15)
units proffered as affordable housing units.
Project
Update:
On July 14,
2005, the Board of Supervisors held a public hearing on this
item. At the applicant’s request, the item was postponed
for 30 days to work out project refinements. Since that
time, the applicant has been diligently working to resolve
the ingress/egress issues for the site and has conducted
several meetings. A potential solution for public road
access involving a new parcel is being considered. The
applicant is in the midst of negotiations with the
landowners. At the time of report preparation, details on
that negotiation were not available or finalized.
Anticipating the arrival of the new submittal, staff
recommends postponement of this item for up to 90 days.
On June 9,
2005, this item was postponed by the Board of Supervisors at
the applicant’s request for 30 days to work out project
refinements and respond to referral agency comments.
Subsequently, the applicant met with staff to respond to
those comments.

Requested
Action of the Board of Supervisors:
Conduct a
public hearing and consider the
attached Ordinance for
adoption of the proposed rezoning. It is recommended the
public hearing remain open and action postponed for up to 90
days in order to allow referral agencies time to review the
plan and proffer statement revisions.

Commission Recommendation:
On May 26,
2005, the Planning Commission recommended denial of this
item as proposed.

Land Area, Location and Zoning:
The property
is located on the east side of Routes 29/15/17. It is zoned
Residential (R-1) with conditions. PIN 6981-44-4079,
outlined in green, is proposed for the clustered
subdivision. PIN 6981-27-6354, is outlined in orange. A
map of the property is shown below.

Neighboring Zoning/Land Use:
The property is bounded by Rural Agricultural (RA) to the
north and east and RA and Residential (R-1) to the south and
west.

Staff
Analysis:
Staff and the appropriate referral agencies have reviewed
this request for conformance with the Comprehensive Plan,
the Zoning Ordinance, and other relevant policies and
regulations. Staff and referral agency findings, comments,
and recommendations from referral agencies are available
upon request.
Summary and Recommendations:
It is
recommended that the Board of Supervisors hold the public
hearing on this item.
The
applicant has been working with an adjacent property owner
to develop a new primary ingress/egress for the residential
subdivision. This alternative could potentially satisfy
VDOT and other referral agency comments.
Staff
highlights the inclusion of the fifteen (15) affordable
units, via proffers, in this project and notes that there is
a need for this type of housing in the County.
