Topic:

A Resolution to Approve Boundary Line Adjustments for Parcels Subject to a Conservation Easement in Marshall District

Topic Description:

The owners/applicants are seeking approval to adjust the boundary lines of parcels subject to a Conservation Easement granted to the Fauquier County Board of Supervisors on December 19, 2006, recorded in Deed Book 1247 at Page 108. The terms of the easement require the Board of Supervisors to approve any boundary line adjustment of the subject parcels. The properties front on Carrington Road (Route 729). The applicants are proposing to adjust the boundary lines of five (5) individual lots in order to follow the natural terrain and land features of the subject parcels. The boundary line adjustment reconfigures the lots into four (4) individual tracts vacating one parcel. The boundary line adjustment is allowed under the terms of the easement.

The subject properties are zoned Rural Agriculture (RA) and Rural Conservation (RC). Adjacent properties to the immediate north are zoned Rural Conservation (RC). Adjacent properties to the west and east are zoned Rural Agriculture (RA) and Rural Conservation (RC). Adjacent properties to the south are zoned Rural Agriculture (RA). There are currently two dwellings and several outbuildings on the property.

Attachment 1 is the proposed boundary line adjustment. The applicants’ Statement of Justification is included as Attachment 2.

Location:

The properties are located at the intersection of Sage Road (Route 724) and Carrington Road (Route 729), in the Marshall District.

Requested Action of the Board of Supervisors:

Consider adoption of the attached resolution.
