Topic: 

Preliminary Plat #PPLT08-MA-002 and Waiver #WVRP08-MA-009: California House

Topic Description:

The applicant is seeking Preliminary Plat approval to divide one parcel of approximately 11.93 acres into five (5) lots, ranging in size from + 1.2 acres to + 3.9 acres. Each lot will be served by well and drainfield.

The applicant has also requested that Subdivision Ordinance Section 10-6 be waived, eliminating the requirement for separate construction drawings. This action has not been the standard practice of the Planning Commission and Board of Supervisors; however, in some instances a modification of the Final Construction Plan may be warranted. In this case, the Preliminary Plat/Final Construction Plan submitted to our office includes all necessary items as required by both plan categories. A copy of the Preliminary Plat/Final Construction Plan is included as Attachment 1. A copy of the Applicant’s Statement of Justification related to the Waiver Request is included as Attachment 2

 

Location,  Zoning and Current Land Use:

The ± 11.93 acres are zoned mostly Residential (R-1) with a small portion of Rural Agriculture (RA).  Adjacent Properties to the north are zoned a combination of Residential (R-1) and Rural Agriculture (RA). Adjacent properties to the west are zoned Residential (R-1). Adjacent properties to the south and east are zoned Rural Conservation (RC) and Rural Agriculture (RA). The property is located on the east side of Fenny Hill Road (Route 816), north of its intersection with Sage Road (Route 724), Marshall District.

Requested Action of the Board of Supervisors: 

No action is necessary to approve the Preliminary Plat, unless a majority of the Board wishes to consider this preliminary subdivision application. Action is requested on the attached Resolution for the Waiver of Subdivision Ordinance Section 10-6. On July 31, 2008, the Planning Commission voted unanimously to approve the California House  Preliminary Plat and recommended approval of the Waiver of Subdivision Ordinance Section 10-6 subject to the following conditions:

  1. The Final Plat shall be in general conformance with the Preliminary Subdivision Plat/Final Construction Plan "The California House Investment Company, L.L.C.” dated January 29, 2008, last revised May 28, 2008, signed by Edwin J. Dodd, Jr. on May 28, 2008 (revised on August 7, 2008 and signed by Edwin J. Dodd, Jr. on August 12, 2008 as directed by the Planning Commission).
     
  2. Evidence that all required offsite easements have been obtained to authorize offsite construction shall be provided prior to issuance of the land disturbance permit and approval of the Final Plat.
