ORDINANCE

AN ORDINANCE AMENDING THE DEFINITION OF

AGRICULTURALLY RELATED USES, COMMERCIAL-2 ZONING DISTRICT AS

FOUND IN SECTION 15-300 (DEFINITIONS) OF

THE ZONING ORDINANCE

            WHEREAS, the Fauquier County Zoning Ordinance provides a definition of “Agriculturally Related Uses” when located within a Commercial-2 zoning district; and

            WHEREAS, this text amendment would change the definition of “Agriculturally Related Uses” to include RV/trailer sales, rental and service as a permitted use; and

            WHEREAS, currently, only the storage of recreational vehicles is permitted under the definition of “Agriculturally Related Uses”; and

            WHEREAS, on June 26, 2003 , the Fauquier County Planning Commission voted to recommend denial of the text amendment, expressing concern about the appropriateness of RV sales and service as an agriculturally related use; and

            WHEREAS, on July 21, 2003 , the Fauquier County Board of Supervisors held a public hearing; and           

      WHEREAS, the adoption of this text amendment would be in the spirit of the Zoning Ordinance and is in the best interest of the citizens of Fauquier County ; now therefore, be it

ORDAINED by the Fauquier County Board of Supervisors this 15th day of September 2003, that Section 15-300 be, and is hereby, amended to provide for RV sales and service as an “Agriculturally Related Use”.  The section will be amended to read as follows:

15-300       DEFINITIONS

AGRICULTURALLY RELATED USES, COMMERCIAL-2 ZONING DISTRICTS:  The following uses are considered to be agriculturally-related when located within a Commercial-2 zoning district:

a)      Lumber yard with incidental retail sales of less than 5,000 square feet in size.

b)      Carpentry/plumbing/electrical/printing/welding/sheet metal shops, less than 5,000 square feet in size.

c)      Auto repair garage including motor vehicle impoundment yard screened from view with a maximum of ten (10) vehicles as an accessory use.

d)      Auto body painting establishment.

e)      Truck and heavy equipment sales, rental, and service; and RV/trailer sales, rental and service.

f)        Wholesale trade establishment.

g)      Contractor's office, shops, and material storage yard, less than one acre in size.

h)      Animal shelter.

i)        Spectator and non-spectator field event activities, Classes A, B, and C.

j)        Kennel/Animal shelter.

k)      Veterinary clinic.

l)        Farm supply establishment.

m)    Taxidermy.

n)      Farm equipment sales, rental, and service.

o)      Commercial storage and processing of bulk agricultural products.

p)      Frozen food locker.

q)      Crop/Livestock farm.

r)       Horse farm.

s)       Truck farm.

t)        Plant nursery/Greenhouse, wholesale.

u)      Plant nursery/Greenhouse, retail.

v)      Forestry.

w)    Recreational vehicle storage area if totally screened from view.

x)      Mini-storage warehouses.
