Resolution Authorizing the Fee
Waiver for the
, Glowicki and Leighton
has been in litigation
regarding a subdivision plat and construction plan for the Coles
Building Corporation and Ms. Leocade Leighton since 1987.
The subdivision, known as Broken Hills Section Five, is
located near Brookside Community in
, and the issue dealt, in
part, with an illegal platting and an identified grading violation
of the Subdivision Ordinance.
July 2003 and August 2003, respectively, the Board of Supervisors
approved the separate rezoning applications of Ms. Leighton, as
well as Ms. Butler and Mr. and Mrs. Glowicki.
Ms. Leighton has filed her final plat, which is pending
approval. The plat can
be recorded, and the downzoning from R-2 to R-1 can commence.
Ms. Butler and the Glowicki family will follow the same

waived the rezoning application fees for the referenced rezoning.
Staff is recommending that the Board of Supervisors waive
the subdivision fees for all three (3) property owners; this
action represents a
effort to assist in the
resolution of this long-standing case.

fee waiver for the rezoning application; and
in July and August of 2003, respectively, the Board of Supervisors
approved the rezoning requests of Ms. Leocade Leighton, Ms. Eleanor Butler
and Mr. and Mrs. Nicholas Glowicki; and
the applicants are pursuing final plats for review, approval and
recordation pursuant to the Proffer Statements of their approved rezoning
applications; now, therefore, be it

September 2003, That the subdivision fees be, and are hereby, waived for
the following properties:
