 Topic:  Ratification of a Waiver of Subdivision Ordinance Section 18-1(C)(1)(d)(2) to Allow the Botha Subdivision to be Developed With a Well Yield of Less Than One (1) Gallon Per Minute Per Each Dwelling Unit to be Connected

Subdivision Ordinance Section 18-1(C)(1)(d)(2) provides that outside of any existing service district, well yields must be capable of providing not less than one (1) gallon per minute per each dwelling unit to be constructed.  On June 19, 2000, the Board of Supervisors affirmed the Planning Commission's approval of the preliminary plat for the Botha Subdivision.  The well developed as the water source for the subdivision was existing at the time of this preliminary subdivision approval.  The hydrogeological study had been completed at that time.  This well has a capacity of approximately 13 gallons per minute rather than the 17 gallons stipulated for a 17 dwelling development.  It is not clear that a waiver of the well yield was granted with the approval of the preliminary plat.  This proposed resolution will ratify the Board's defacto waiver of Subdivision Ordinance Section 18-1(C)(1)(d)(2) and its approval of the Botha preliminary plat.
