RESOLUTION A RESOLUTION TO RECOMMEND DENIAL
OF SPECIAL EXCEPTION # SE02-L-30 JAMES R. AND BETTY L. MILLS,
PROPERTY OWNERS COMMUNITY WIRELESS STRUCTURES,
APPLICANT PARCEL IDENTIFICATION NUMBER
6888-38-9459-000
WHEREAS, James R. and Betty L. Mills, owners, and Community
Wireless Structures, applicant, have filed an application to
construct a 150-foot telecommunications tower under the provisions of
Articles 5-2000 and 11-102 of the Fauquier County Zoning Ordinance; and
WHEREAS, on June 27, 2002, the Planning Commission held a public
hearing on this application and has made a recommendation of denial to the
Board of Supervisors; and
WHEREAS, on August 19,
2002, the Board of Supervisors conducted a public hearing on this
application and considered the written and orally presented information of
the applicants; and WHEREAS, the Board of
Supervisors has determined that the applicant has failed to demonstrate
that telecommunications services could not be provided at a height lower
than the requested 150 feet; and WHEREAS, the Board of
Supervisors has determined that the owner has other reasonable uses of the
property; now, therefore, be it
RESOLVED by the Fauquier County Board of Supervisors this 16th
day of September 2002, That the application by Community Wireless
Structures to construct a 150-foot telecommunications tower on the
property of James R. and Betty L. Mills is not in substantial accordance
with the Fauquier County Comprehensive Plan; and, be it RESOLVED FURTHER, That Special Exception Application #SE02-L-30 be, and is hereby, denied, as it does not satisfy the standards for approval of a special exception application as outlined in Section 5-006, the additional standards for Public Utilities uses in Section 5-2002 nor the provisions in Article 11 of the Fauquier County Zoning Ordinance. |
