A RESOLUTION TO AMEND THE PROFFERS FOR THE VINT HILL ECONOMIC DEVELOPMENT AUTHORITY AS RELATED TO CONTINUED ACCESS TO FINCH LANE AND TO WAIVE THE PUBLIC HEARING REQUIREMENT PURSUANT TO SECTION 15.2-2302 OF THE CODE OF VIRGINIA
WHEREAS, SECTION 15.2-2302 of the Code of Virginia now allows for the amendment of proffers not related to use or density on an approved rezoning by action of the Board of Supervisors, with waiver of a public hearing ; and
WHEREAS, the Vint Hill Economic Development Authority (VHEDA) has requested such action on an amendment to a proffered condition as it relates to the approved Concept Development Plan for Vint Hill and the continued access to Finch Lane as part of the long-term site development of the Vint Hill project; and
WHEREAS, Fitch Lane is an existing VDOT-maintained public street; and
WHEREAS, the Board of Supervisors considered the analysis and recommendation outlined in the agenda request and concluded that retaining continued access along Finch Lane to Rogues Road for the development would help to disperse traffic entering and exiting the site; now, therefore, be it
RESOLVED by the Fauquier County Board of Supervisors this 8th day of October 2009, That the public hearing for the amendment to proffers for the Vint Hill Economic Development Authority (Case Number RZ99-CR-07) is hereby waived; and be it
RESOLVED FURTHER, That the modification to the Concept Development Plan shown in Attachment 2 of the Agenda Request with a road connection from Kennedy Road to Finch Lane is hereby approved and VHEDA’s commitment as specified in their letter dated September 29, 2009 to “upgrading Finch Lane to VDOT standards no later than the issuance of the final occupancy permits for new building construction square footage in excess of 200,000 square feet of FAR in Land Bay V” is hereby accepted as a revision to the proffers.
