RESOLUTION

A Resolution Initiating a Zoning Ordinance Text Amendment to SECTION 5-1812 OF THE FAUQUIER COUNTY ZONING ORDINANCE REGARDING FARMERS’ MARKETS

            WHEREAS, it is appropriate to amend the Zoning Ordinance to regulate farmers’ markets; and

            WHEREAS, Fauquier County seeks to provide additional flexibility to those proprietors of farmers’ markets; and

            WHEREAS, adoption of the attached amendments to Section 5-1812 supports good zoning practice, convenience and the general welfare; now, therefore, be it           

            RESOLVED by the Fauquier County Board of Supervisors this 9th day of October 2008, That amendments to Section 5-1812 related to community farmers’ markets be, and are hereby, initiated and referred to the Planning Commission for public hearing and its recommendation; and, be it

            RESOLVED FURTHER, That the following text represents the proposed changes for consideration:            

5-1812                         Additional Standards for a Farmer's Market

7.   A farmer's market shall be conducted on the same lot as contains the bona fide, primary residence of the property owner or lessee, or on an adjacent property under the same ownership or lease as the parcel containing the primary residence of the proprietor, unless otherwise waived by the Board of Supervisors by approval of a Special Exception.
