RESOLUTION

A RESOLUTION TO APPROVE A MODIFICATION TO SECTIONS 10-6 AND 9.5.B.33 OF THE SUBDIVISION ORDINANCE TO ELIMINATE THE REQUIREMENTS FOR SEPARATE CONSTRUCTION DRAWINGS AND A JURISDICTIONAL DETERMINATION FOR THE HAWORTH PROPERTY PRELIMINARY PLAT (WVRP09-CR-003 AND WVRP09-CR-004)

WHEREAS, Stanley C. and Mildred W. Haworth, owners, are seeking a modification to Subdivision Ordinance Section 10-6 to eliminate the requirement for separate construction drawings; and

WHEREAS, the owners, are also seeking a modification to Subdivision Ordinance Section 9-5.B.33 to eliminate the requirement for a jurisdictional determination of wetlands; and

WHEREAS, the owner is seeking to divide a 309.9 acre parcel of land into two (2) lots, which are approximately 301.97 and 7.90 acres; and

WHEREAS, the Preliminary Plat includes all of the necessary items as required by the Preliminary Plat and Final Construction Plan categories; and

WHEREAS, on September 25, 2008, the Fauquier County Planning Commission unanimously recommended approval of the proposed Subdivision Ordinance waivers; now therefore, be it

RESOLVED by the Fauquier County Board of Supervisors on this 9th day of October 2008, That Subdivision Ordinance Sections 10-6 and 9.5.B.33 be, and are hereby waived to allow any Construction Plan requirements to be included on the Preliminary Plat, and to waive the requirement to provide a U.S. Army Corps of Engineers Jurisdictional Determination with the Preliminary Plat.
