Consideration of the Entire Effect of a Boundary Line
Adjustment Upon Multiple Nonconformities

Topic Description: |

The proposed text amendment
would add a new Section 10-104 to the Zoning Ordinance to
permit the Zoning Administrator to consider the net effect
of multiple non-conformities when evaluating a boundary line
adjustment and approve such an adjustment if at least one of
the nonconformities is made more conforming. There are two
proposed alternatives. The Planning Commission recommended
the adoption of alternative 2, which enumerates specific
examples of nonconformities which may be relied upon in the
review process. The text of alternative 1 is broader in
scope and permits the consideration of nonconformities
related to zoning, subdivision and other County ordinances
and state code requirements. Either version would permit
the consideration of the effect of such adjustment which
either increase or decrease the size of drainfields,
increase or decrease the setbacks from structures, and
increase or decrease lot sizes.
