RESOLUTION

A RESOLUTION AUTHORIZING THE COUNTY ADMINISTRATOR TO EXECUTE AN AGREEMENT WITH THE FAUQUIER COUNTY WATER AND SANITATION AUTHORITY TO FUND THE ENGINEERING OF THE NECESSARY IMPROVEMENTS TO THE VINT HILL SEWAGE TREATMENT PLANT

WHEREAS, currently the Vint Hill Sewage Treatment Plant, which services the New Baltimore Service District and Vint Hill, has a permitted capacity of 0.60 mgd; and

WHEREAS, the current permit includes authorization to expand the plant to 0.95 mgd; and

WHEREAS, the current Comprehensive Plan for the New Baltimore Service District assumes that the plant will be expanded to 0.95 mgd; and

WHEREAS, under the new regulations from the Department of Environmental Quality, an expansion of a plant must receive a Certificate to Operate by December 31, 2010; and

WHEREAS, the Fauquier County Water and Sanitation Authority (WSA) has stated that it must begin engineering for any expansion not later than the end of summer 2007; and

WHEREAS, at the present time the WSA does not have firm commitments for either engineering or the construction, but must begin engineering the plant expansion now in order to meet the deadline of December 31, 2010; and

WHEREAS, the WSA has requested that Fauquier County advance the $500,000 in funds necessary to complete the engineering of the plant expansion subject to repayment if other entities determine to contribute or through payment of tap fees; now, therefore, be it

RESOLVED by the Fauquier County Board of Supervisors this 11th day of October 2007, That the County Administrator be, and is hereby, authorized to execute an agreement with the Fauquier County Water and Sanitation Authority to fund the engineering of the necessary improvements to the Vint Hill Sewage Treatment Plant, said $500,000 loan to be repaid upon mutually agreeable terms and conditions; and, be it

RESOLVED FURTHER, That the $500,000 loan shall be taken from the County’s Utility Fund and charged to account 4-310-044410-3140.
