A Resolution to Approve a Waiver Allowing a Private Street that Does Not Connect Directly to a State Maintained Street

 

Topic Description:

The owner is seeking a waiver of Zoning Ordinance Section 7-302 1.B., Limitations, which would allow a subdivision on a private street that does not connect directly to a state maintained street. In May 2006, an administrative subdivision was approved on this property that created Lot 13A (61 acres) and Lot 13B (10 acres). The 10-acre lot was to be served by a 50-foot ingress-egress easement, Whisper Drive, which connects directly to Brent Town Road (Route 612). In addition, Lot 13B has access to another private street (Seneca Lake Drive). Now the applicant is requesting a waiver so the portion of Whisper Drive that splits Lot 13A may be vacated. This would result in the section Whisper Drive intended to access Lot 13B would first connect to Seneca Lake Drive rather than a direct connection to Lot 13B. The applicant has attempted to obtain a second entrance off of Brent Town Road in order to create a new ingress-egress easement that would serve Lot 13B; however, the Virginia Department of Transportation (VDOT) wants to limit new access points to Brent Town Road and has advised against this option.

Attachment 1 provides a location map for the subject parcels. Attachment 2 shows the approved division showing the current and proposed access to the lots, and the applicant’s Statement of Justification is included as Attachment 3.

 

Planning Commission Action:

On September 28, 2006, the Planning Commission unanimously recommended approval of the applicant’s request for a waiver of Section 7-302 1.B. of the Zoning Ordinance. The Planning Commission staff report is available upon request.

Requested Action of the Board of Supervisors:

Consider adoption of the attached resolution.
