Description:
The
applicant wishes to rezone approximately 165.0 acres from
Residential (R-1) conditional to Residential R-1 and R-2
with proffers to allow for a residential subdivision.
Based on
recent meetings and discussions with the applicant, staff
anticipates receipt of revised proffers that will further
clarify the proposal. The proposal includes fifteen (15)
units proffered as affordable housing units.
Project
Information:
On
September 8, 2005, a public hearing was held and left open,
on this item, to further refine the project ingress/egress
with an adjacent property owner. As a result, the
application has added a portion of land defined as PIN #
6981-54-4190-000 to this request. This parcel will provide
direct ingress/egress, via a public road, for the
residential subdivision; this parcel does not request to be
rezoned. To reflect these access improvements and other
minor revisions, new plans and proffers were submitted.
Referral agencies have reviewed the plan and proffer
statement revisions.

Requested Action of the Board of Supervisors:
Conduct a
public hearing and consider adoption of the
attached Ordinance.
Please note
that the attachments will change as a signed version of the
draft proffers is anticipated prior to the Board meeting.

Commission Recommendation:
On May 26,
2005, the Planning Commission recommended denial of this
item as proposed.

Land Area, Location and Zoning:
The
property is located on the east side of Routes 29/15/17. It
is zoned Residential (R-1) with conditions. PIN #
6981-44-4079, outlined in green, is proposed for the
clustered subdivision. PIN # 6981-27-6354, is outlined in
orange. PIN # 6981-54-4190-000 is underneath the caption
“clustered subdivision”. A map of the properties is shown
below.

Neighboring Zoning/Land Use:
The property is bounded by Rural Agricultural (RA) to the
north and east and RA and Residential (R-1) to the south and
west.

Staff
Analysis:
Staff and the appropriate referral agencies have reviewed
this request for conformance with the Comprehensive Plan,
the Zoning Ordinance, and other relevant policies and
regulations. Staff and referral agency findings, comments,
and recommendations from referral agencies are available
upon request.
Summary and Recommendations:
It is
recommended that the Board of Supervisors hold the public
hearing on this item and take action on it. Note that
action must first be taken on the companion Comprehensive
Plan Amendment before action on the rezoning application can
occur. At its September meeting, the Board of Supervisors
directed staff to prepare an amendment to the Opal Service
District Plan. The purpose of the amendment was to include
a small portion of the referenced rezoning application into
the Service District due to project redesign necessary to
access Clarkes Road.
Staff
highlights the inclusion of the fifteen (15) affordable
units, via proffers, in this project and notes that there is
a need for this type of housing in the County.
