Attached is a proposed resolution directing the County
Administrator to institute the road abandonment process for
a portion of Old Tavern Road (Route 245). In 1983,
fifty-five (55) feet of right-of-way measured from the
centerline of Old Tavern Road was dedicated to the Board of
Supervisors. Old Tavern Road is classified as a Rural Minor
Arterial in the County’s Comprehensive Plan and, as such,
should have between 80 to 160 feet of right-of-way.
James R. Cheatham has requested that the County abandon a
portion of the Old Tavern Road right-of-way along Ronda L.
Cheatham’s property at the intersection of Old Tavern Road
and Old Winchester Road (Route 845). Mr. Cheatham would
like approximately 17 feet to be abandoned for a proposed
boundary line adjustment between the Cheatham property (PIN
6978-86-8792-000) and adjoining T.W. Winfree parcel (PIN
6978-86-7727-000). In addition, it appears there is a
portion of the Cheatham porch in the right-of-way. Staff
and Virginia Department of Transportation (VDOT) recommend
that no more than 15 feet be abandoned, which would permit
the minimum right-of-way of 80 feet to remain in place for
future improvements to Old Tavern Road and to meet the
minimum Rural Minor Arterial right-of-way requirements.
Below is a location map of the property, and attached is a
copy of the 1983 Deed of Dedication for the right-of-way
dedication.

Recommendation: |

On July 28,
2004, the Transportation Committee considered making a
recommendation on the initiation of the abandonment, but
postponed formal action awaiting additional information
related to the status of the right-of-way. At its October
5, 2004 meeting, the Transportation Committee agreed to not
make a recommendation to the Board of Supervisors on the
proposed abandonment. |
