A Resolution to Adopt Purchase of Development Rights (PDR) Program Operating Procedures Within the Old Dominion Electric Cooperative (ODEC) Mitigation Area

Topic Description:

On February 19, 2002 , the Board of Supervisors adopted the Purchase of Development Rights Program to support the agricultural economy of Fauquier County.  On July 21, 2002, the first five farms totaling 1,624 acres were approved for preservation by the Board of Supervisors.  ODEC has obtained its building permit for the new peaking power plant.  A total of $1.5 million will be forthcoming to Fauquier County from ODEC as mitigation funding for the area within a five mile radius of the power plant.  In anticipation of receipt of these funds, procedures are needed for implementation of the PDR Program within this area.  The procedures consist of eligibility criteria, ranking criteria and an application timeline.  In addition, a PDR Review Committee will be appointed.  These procedures are attached. 

Requested Action of the Board of Supervisors: 

Consider adoption of the attached resolution.

Financial Impacts Analysis:

It is anticipated that Fauquier County will receive $1.5 million from Old Dominion Electric Cooperative (ODEC) specifically for the PDR Program on eligible properties within  five miles of the ODEC power plant.  These funds will only be available for the PDR Program and may not be used, borrowed or otherwise used as leverage for other funds for any other projects.
