Approving SPEX04-CR-005: A Category 23 Special Exception Topic Description: The purpose of the request is to extend the performance time
frame contained within the Applicant’s Special Exception conditions
approved in February of 2002. Condition
3 of the original Special Exception stated “that within eighteen (18)
months of approval date, the applicant shall remove the existing low water
crossing and replace it with a bridge structure that spans Licking Run.”
It also said that “the applicant shall obtain a Conditional
Letter of Map Revision (CLOMR) from the Federal Emergency Management
Agency within six (6) months of the approval date.” See Attachment
1.
The applicant is requesting an extension of six (6) months so that
total compliance with SE01-CR-10 can be accomplished (Attachment
2).

Within six (6) months of the approval date of this extension, the
applicant shall remove the existing “low water crossing” and replace

The span shall be built in accordance with all applicable federal,
state, and local regulations to specifications approved by the 2.
