ORDINANCE AN ORDINANCE TO AMEND SUBSECTION 3 OF SECTION 204.2 OF THE DESIGN STANDARDS MANUAL TO CLARIFY ITS APPLICATION TO POINT SOURCE STORMWATER RUNOFF WHEREAS, Subsection 3 of Section 204.2 of the County’s Design Standards Manual currently provides that all stormwater runoff generated by new development shall not be discharged into a jurisdictional wetland or local water; and WHEREAS, the proposed amendment would clarify that this provision is intended to apply to point source generated stormwater runoff generated from new development, and not from non-point source runoff; and WHEREAS, on October 11, 2007, the Fauquier County Board of Supervisors initiated this text amendment; and WHEREAS, on November 8, 2007, the Fauquier County Board of Supervisors held a public hearing on this amendment; now, therefore, be it ORDAINED by the Fauquier County Board of Supervisors this 8th day of November 2007, That Subsection 3 of Section 204.2 of the Design Standards Manual to clarify its application to point source stormwater runoff, shall be amended to read as follows: An Ordinance to Amend Section 204.2 (3) of the Design Standards Manual General Policy for BMP and Stormwater Quality: 1. All development or redevelopment occurring within the County shall incorporate water quality measures (Best Management Practices). 2. The current edition of the Northern Virginia BMP Handbook, prepared by the Northern Virginia Planning District Commission (NVPDC), shall be used in the design and review of BMP facilities using the Occoquan Method. Other design criteria may be used solely at the discretion of the program administrator. Sufficient support material to document the methodology will be required (see appendix). 3. All point-source stormwater runoff generated from new development shall not be discharged into a jurisdictional wetland or local water body without adequate treatment. For the purpose of this subparagraph, a tree conservation easement is considered a method of adequate treatment. |
