The applicant is requesting approval of a Category 29
Special Exception to waive the public street requirement in
the Rural Agriculture (RA) zone to allow Chattins Run Lane
to be designed and constructed as a Type III private
street.
Project Information:
On July 13, 2006, the applicant received Preliminary Plat
approval to divide one parcel of approximately ±98.3 acres
into six (6) single-family residential lots ranging in size
from ±1.8 to ±2.7 acres, including a non-common open space
lot of 83.85 acres. This development represents a by-right
cluster subdivision in the Rural Agriculture zoning
district. The proposed cluster is internal to the subject
property with a cul-de-sac (Chattins Run Lane) of
approximately 1,490 feet, exclusive of the turnaround. The
development is situated in this manner to avoid multiple
entrances and impacts on the property’s frontage along
Maidstone Road.
Section 7-301 of the Zoning Ordinance provides that Private
Streets are prohibited for all subdivisions in RA, RC and
residential zones unless a Special Exception is obtained in
accordance with the requirements of Section 5-2800 or
5-2900. Section 5-2900 further provides that, in
residential, RA and RC zones, the Board of Supervisors may
grant a Special Exception to permit the construction of
private streets within a subdivision where the following
standards are met:
- The
requirements of the Virginia Department of
Transportation necessary for the dedication of public
streets will not permit the development of the proposed
subdivision in a manner which is in harmony with the
surrounding character of the neighborhood or the
proposed development scheme.
- The
proposed private streets, based upon anticipated traffic
generation volume, would adequately serve the lots to be
developed and provide sufficient emergency vehicle
access to the subdivision, and demonstration that
adequate provisions will be made to provide for
continuing maintenance and repair of the streets by a
homeowners association. For any subdivision with 80 lots
or more, a traffic impact analysis must be provided to
establish the justification for the request.
Fauquier
County Zoning Ordinance Section 7-303 defines that there are
no design standards for Type III private streets.
Subsequently, Section 7-304 stipulates that there are no
construction standards for Type III private streets. In the
applicant’s
Statement of Justification, they state it is
their intent to design and construct a Type III private
street that is in harmony with the character of the
surrounding community and northern Fauquier County as a
whole.

Planning
Commission Action:
On October
26, 2006, the Planning Commission unanimously recommended
approval of the Category 29 Special Exception to waive the
public street requirement in the Rural Agriculture (RA) zone
to allow Chattins Run Lane to be designed and constructed as
a Type III private street.
