Preliminary Plat PPLT06-MA-020 - O’Bannon Farm, Marshall District


Topic Description:

The applicant is seeking Preliminary Plat approval to divide a Rural Agricultural (RA) zoned parcel of approximately 82.0071 acres into two (2) single-family residential lots, a 2.823-acre lot with a non-common open space lot of 79.1841 acres.  The lots will be served by individual wells and septic.  This subdivision will exhaust all subdivision potential on the property.  A copy of the Preliminary Plat is included as Attachment 1.

The applicant requests that Subdivision Ordinance Section 10-5 be waived or modified, eliminating the requirement for construction drawings.  In some instances, a modification of the Final Construction Plans may be warranted. 


In addition, the applicant is requesting a waiver/modification of both the street tree and canopy requirements for residential subdivisions as outlined in Article 7-603 (2) of the Fauquier County Zoning Ordinance.  Typically, the Landscape Waiver Request would be included with the Final Construction Plans; however, since the applicant is requesting the Final Construction Plans be modified, the waiver request is applicable at this time.  The Fauquier County Zoning Ordinance allows the Zoning Administrator to grant such a waiver/modification for those parcels eligible under Section 15.2-961 of the Code of Virginia for reasonable exceptions or deviations for reasonable development of farm land.  The Zoning Office has granted the waiver for the residue parcel. 

Zoning/Acreage/Land Use:


The parcel contains approximately 82.0071 acres and is zoned Rural Agricultural (RA).  Adjacent properties to the north, south and west are zoned RA and properties to the east are zoned a mixture of RA and Rural Conservation (RC). 



The parcel is located at 11089 Hume Road, south of Hume Road (Route 635) and north of Dixon’s Mill Road (Route 732).   

















 Requested Action of the Board of Supervisors:

No action is necessary, unless a majority of the Board wishes to consider this preliminary subdivision application.  On September 28, 2006, the Planning Commission unanimously voted to approve the O’Bannon Preliminary Plat, subject to the following condition:

·        The Final Plat shall be in general conformance with the Preliminary Subdivision Plat / Final Construction Plan entitled "Preliminary Plat / Final Construction Plan" dated February 16, 2006, revised October 5, 2006.
