ORDINANCE AN ORDINANCE TO DECLARE BUSINESS personal PROPERTY Owned by MIDDLEBURG humane foundation EXEMPT FROM Taxation WHEREAS, Middleburg Humane Foundation is a 501(c)(3) organization owning personal property in Fauquier County; and WHEREAS, Middleburg Humane Foundation has requested an exemption from personal property taxation in order to permit it to be better able to use its financial resources for charitable purposes; and WHEREAS, §8-71 of the County Code and §58.1-3651 of the Code of Virginia authorize the property of charitable organizations to be classified as exempt from taxation; and WHEREAS, prior to granting a charitable organization an exemption from property tax the Board of Supervisors must conduct a public hearing and adopt an ordinance granting the exemption; and WHEREAS, the Board of Supervisors has conducted a public hearing and determined that it is appropriate and in the public interest to classify the personal property of Middleburg Humane Foundation to be exempt from taxation; now, therefore, be it ORDAINED by the Fauquier County Board of Supervisors this 12th day of November 2009, That the personal property of Middleburg Humane Foundation be, and is hereby, declared exempt from taxation; and, be it ORDAINED FURTHER, That the continuance of this exemption shall be conditioned upon the continuous use of this property in accordance with the purpose for which this organization has been designated; and, be it ORDAINED FINALLY, That this exemption be effective for the tax year beginning January 1, 2009.
