Topic               A Resolution Authorizing the Execution of a Water System Operation and

                        Transfer Agreement for Botha Village , Opal, Virginia

Fauquier County and the Fauquier County Water and Sanitation Authority (WSA) have previously agreed, in concept, to an approach regarding the operation of the water system to serve the Botha Village subdivision.  The agreement to document this understanding has been reviewed by the County/WSA Liaison Committee and County Attorney.  The agreement provides for the operation and maintenance of the water system by WSA for a five-year period.  The agreement provides for the transfer of ownership from the County to WSA subject to County construction of a supplemental water resource, or a determination that the level of nitrates has stabilized at an acceptable limit, or an acceptable plan to provide nitrate remediation.  The agreement is attached for review.

Requested Action of the Board of Supervisors

Consider adoption of the attached resolution.

Financial Impacts Analysis

Funds have been earmarked in the Utility Fund to provide for the possible development of an alternative water resource and for a portion of the work to secure the existing well site and to identify a supplemental water resource.  Available balances from a previous groundwater study in the amount of $100,000 are available for the Botha project if needed to complete an option identified in the transfer agreement.
