tract of land, which is identified as a portion of PIN
#7915-31-0883 from the New Baltimore Sewer Service District Area,
and reconfirming that PIN 7914-39-5958, 7914-39-7816,
7915-31-2397, 7915-31-6181 and 7915-40-0327 are not located within
the New Baltimore Sewer Service District Area.

Conduct the public hearing, and consider adopting the attached
resolution amending the New Baltimore Service District Plan.

Description:

|
At
its
September 16, 2002
meeting, the Board of
Supervisors initiated and referred the proposed amendment to the
sewer service area of the New Baltimore Service District for
Planning Commission public hearing and recommendation. The
amendment collapses the area to be served for only that portion of
the
Brookside
and Brookside Farm
affected by the recently approved preliminary subdivision plat.
That referenced plat was approved subject to the
established Planning Commission conditions, plus a Board of
Supervisors added clarification condition that plat approval was
restricted to a maximum total of 975 single family lots.
The
Brookside
and Brookside Farm
applicant agreed to that residential lot restriction, and this
amendment identifies specific parcels not intended to be included
in the designated sewered area of the New Baltimore Service
District Plan.
On
October 24, 2002
, the Planning Commission
held a public hearing on the proposed amendment and forwarded it
to the Board of Supervisors with a unanimous recommendation that
it be approved as presented.

RESOLUTION
A RESOLUTION APPROVING THE AMENDMENT TO THE NEW
BALTIMORE SERVICE DISTRICT PLAN REGARDING AREAS PLANNED AND NOT PLANNED
FOR PUBLIC SEWER
WHEREAS, the Board of Supervisors initiated
an amendment to the Comprehensive Plan for the New Baltimore Service
District to conform to the approved 975 lot preliminary subdivision for
the Brookside Farm/Brookside Communities; and
WHEREAS, on
September 16, 2002
, the Board of Supervisors referred that proposed amendment to the
Planning Commission for Public hearing and recommendations; and
WHEREAS, on October 24, 2002, the Planning
Commission conducted its public hearing on the referenced plan amendment
and forwarded it to the Board of Supervisors with a recommendation of
approval; and
WHEREAS, the Board of Supervisors conducted
a public hearing on the referenced amendment to the Comprehensive Plan;
now, therefore, be it
RESOLVED by the Fauquier County Board of Supervisors this 18th
day of November 2002, That a portion of the 29.20 acre parcel of land,
more particularly described as PIN #7915-31-0883, which is not a part of
the approved preliminary subdivision plat of the Brookside Subdivision
(#PPR02-S-03), be removed from the designated sewered area of the New
Baltimore Service District; and, be it
RESOLVED FURTHER, That the Board of Supervisors does hereby reconfirm
that the following parcels are not within the sewered area of the New
Baltimore Service District, said parcels being more particularly described
as PIN 7914-39-5958, 7914-39-7816, 7915-31-2397, 7915-31-6181 and
7915-40-0327.
