The owner/applicant is seeking a waiver of Zoning Ordinance
Section 7-302 1.C., Limitations, which would allow a
right-of-way that is less than fifty (50) feet in width. The
applicant is proposing to divide a 10.10-acre parcel into
two lots, an administrative lot of approximately 2 acres and
a residue of 8.10 acres. A 25-foot wide strip of the subject
property fronts on Watery Mountain Road (Route 787). As
proposed, the lots would be accessed by a 25-foot easement
that would connect to Watery Mountain Road (Route 787).
The property is zoned Rural Conservation and Rural
Agriculture (RA). The subject property has the subdivision
potential to be divided into two (2) lots. The property is
located on the east side of Watery Mountain Road (Route
787). Currently, the applicant accesses his property via
Watery Mountain Road.
Refer to Attachment 1 which identifies the parcel location
more precisely south of Rte. 17 off Watery Mountain Road.
Attachment 2 presents a sketch plan for the division and
access to the lots, while the Applicant’s justification is
