RESOLUTION

A Resolution to Authorize the Chairman of the Board of Supervisors to Execute a Consent to a Deed of Trust on the Leasehold Interest of Midland Development Corporation

WHEREAS, the lease between Fauquier County and Midland Development Corporation permits Midland Development Corporation to execute a deed of trust against the leasehold interest held by Midland Development Corporation; and

WHEREAS, Midland Development Corporation intends to borrow funds to construct T‑Hangars at the airport, and has applied for a loan to be secured by its leasehold interest in the property; and

WHEREAS, the lender has requested that the County execute a consent to the assignment of its interest and to the deed of trust; now, therefore, be it

RESOLVED by the Fauquier County Board of Supervisors this 8^th day of December 2005, That the Chairman of the Board of Supervisors be authorized to execute a Landlord’s Consent, subject to such amendments as may be requested by the County Attorney.
