RESOLUTION 

A Resolution to APPROVE comprehensive plan CONFORMANCE DETERMINATION CCRV05-CT-001 TO PROVIDE WATER SERVICE TO A PARCEL OUTSIDE OF the Warrenton Service District

              WHEREAS, Caroline Atlee Timlin, owner, and Toll Brothers, Inc., applicant have requested a Comprehensive Plan Conformance Determination CCRV05-CT-001 to provide water service to land located outside of the Warrenton Service District on the property identified by PIN 6994-47-6359-000; and

 

WHEREAS, the requested application for the Comprehensive Plan Conformance Determination would allow for the extension of public water to serve the aforementioned property; and

 

WHEREAS, the Code of Virginia, Section 15.2-2232, requires determination by the Board of Supervisors that this proposal is in substantial accord with the Comprehensive Plan; and       

 

WHEREAS, on October 27, 2005 and September 29, 2005, the Planning Commission held public hearings on the application and voted to recommend approval of the Comprehensive Plan Conformance Determination; and

 

            WHEREAS, on December 8, 2005, the Fauquier County Board of Supervisors conducted a public hearing and considered the written and oral testimony; and

WHEREAS, the Board of Supervisors concurs with the Planning Commission and it has determined that the application for the extension of water services outside of the Warrenton Service District is in conformance with the Fauquier County Comprehensive Plan in accord with the Code of Virginia, Section 15.2-2232; and

WHERAS, this approval is contingent on agreement to guarantee improvement of both Atlee Road and Frytown Road and that no water connections are to be available until such improvements are either constructed or bonded for construction; now, therefore, be it

            RESOLVED by the Fauquier County Board of Supervisors this 8th day of December 2005, That Comprehensive Plan Conformance Determination CCRV05-CT-001, Caroline Atlee Timlin; owner, and Toll Brothers, Inc., applicant, be, and is hereby, approved; and, be it

 

RESOLVED FINALLY, That the provision of public water to this property is consistent with the Comprehensive Plan and that water connections shall be available upon the construction or bonding for construction of improvements to Atlee and Frytown Roads.
