Topic: 

A Resolution Referring a Request to Withdraw from an Open Space Agreement with a Landowner to the Agricultural & Forestal Advisory Committee and Planning Commission

Topic Description:

One of the options for qualifying for the special land use assessment program under the open space category is to have a recorded agreement with the governing body.  The landowners listed on the attached resolution have signed the 8 year Open Space Use Agreement and, on March 31, 2004, it was accepted by the Board of Supervisors.   The landowners are now requesting to withdraw from the agreement.

The Open Space Use Agreement stipulates that the procedure for termination is to follow the same process as that for withdrawal from an Agricultural & Forestal District.  State Code Section 15.2-4314 contains the procedure for withdrawal from a district.  It requires the Board of Supervisors to refer the request for withdrawal to the Agricultural & Forestal District Advisory Committee and the Planning Commission for recommendation.  The Board is to then schedule a public hearing to decide on the matter. 

Requested Action of the Board of Supervisors: 

Consider adoption of the attached resolution.
