RESOLUTION

A RESOLUTION TO DENY ASHLEY GLEN DAYCARE CENTER (EDGEWOOD EAST SECTION D): SPECIAL EXCEPTION AMENDMENT SEAM07-LE-004; SPECIAL PERMIT SPPT07-LE-015; AND SPECIAL EXCEPTION AMENDMENT SEAM07-LE-007

            WHEREAS, the owners of the property, identified by PIN 6889-50-5884-000, have requested to amend a previously approved Category 1 (Major Residential Development) Special Exception to create an additional .98 acre lot for a proposed pre-school/daycare facility; amend a previously approved Category 23 Special Exception to allow for fill in the FEMA 100-year floodplain for construction and placement of utilities; and request a Category 5 Special Permit to allow for the proposed use; and

            WHEREAS, on September 27, 2007, the Planning Commission held a public hearing on this item and recommended denial; and

WHEREAS, on December 13, 2007, the Fauquier County Board of Supervisors held a public hearing and considered written and oral testimony; and

WHEREAS, the proposed use will hinder and discourage the appropriate development and use of adjacent land and buildings and impair the value of adjacent land and buildings in violation of Section 5-006 of the Zoning Ordinance; and

WHEREAS, that the proposed use will be incompatible with existing or planned development in the general area, as set forth in Section 5-006 of said Zoning Ordinance, and will be incompatible with the general area and the Comprehensive Plan.

WHEREAS, that the proposed use fails to comply with and is not in conformity with all the applicable standards of Article 5 of said Zoning Ordinance and all other applicable requirements of said Zoning Ordinance; and

WHEREAS, the Fauquier County Board of Supervisors agreed with the recommendation of the Planning Commission and found that the application would negatively affect the common open space in the Edgewood East Subdivision; now, therefore, be it

            RESOLVED by the Fauquier County Board of Supervisors this 13th day of December 2007, That Special Exception Amendment SEAM07-LE-004; Special Permit SPPT07-LE-015; and Special Exception Amendment SEAM07-LE-007, AGT, LLC, Owner, and Three Flags Associates, Applicant, be, and are hereby, denied.
