A RESOLUTION IN SUPPORT OF THE DIRECTOR OF COMMUNITY DEVELOPMENT’S ISSUANCE OF A WAIVER TO SECTION 204.2(3) OF THE DESIGN STANDARDS MANUAL FOR ALL PHASES OF THE BROOKSIDE PROJECT
WHEREAS, Subsection 3 of Section 204.2 of the County’s Design Standards Manual provides that all stormwater runoff generated by new development shall not be discharged into a jurisdictional wetland or local water; and
WHEREAS, the Brookside project has worked with the U.S. Army Corps of Engineers and the Virginia Department of Environmental Quality on the delineation of wetland impacts, including recorded easements, and has valid permits from those agencies; and
WHEREAS, the Brookside project has complied with the water quality provisions of the Virginia Stormwater Management Law and employed methods to improve water quality to meet with the general intent of the requirement of Section 204.2(3); and
WHEREAS, the Fauquier County Board of Supervisors initiated a text amendment to Subsection 3 of Section 204.2, held a public hearing and considered the amendment related to the discharge of non-point source stormwater runoff generated from new development into jurisdictional wetlands; and
WHEREAS, the Fauquier County Board of Supervisors does not support universal changes to Subsection 3 of Section 204.2 beyond those approved with the text amendment; now, therefore, be it
RESOLVED by the Fauquier County Board of Supervisors this 13th day of December 2007, That it supports the Director of Community Development in the issuance of a waiver to only Subsection 3 of Section 204.2 of the Design Standards Manual pursuant to Section 105 of the DSM for all internal phases of the Brookside project.
