Option 2 ORDINANCE AN ORDINANCE TO DELETE SUBSECTION 3 OF SECTION 204.2 OF THE DESIGN STANDARDS MANUAL WHEREAS, Subsection 3 of Section 204.2 of the County’s Design Standards Manual currently provides that all stormwater runoff generated by new development shall not be discharged into a jurisdictional wetland or local water; and WHEREAS, this provision is in conflict with those of the Virginia Stormwater Management Law, adopted in 2005; and WHEREAS, there are Federal and State agencies that have permitting oversight for jurisdictional wetlands and the water of the United States; and WHEREAS, on October 11, 2007, the Fauquier County Board of Supervisors initiated this text amendment; and WHEREAS, on November 8, 2007, the Fauquier County Board of Supervisors held a public hearing on this amendment; now, therefore, be it ORDAINED by the Fauquier County Board of Supervisors this 13th day of December 2007, That Subsection 3 of Section 204.2 of the Design Standards Manual shall be deleted and Section 204.2 shall be read as follows: An Ordinance to Amend Section 204.2 (3) of the Design Standards Manual General Policy for BMP and Stormwater Quality: 1. All development or redevelopment occurring within the County shall incorporate water quality measures (Best Management Practices). 2. The current edition of the Northern Virginia BMP Handbook, prepared by the Northern Virginia Planning District Commission (NVPDC), shall be used in the design and review of BMP facilities using the Occoquan Method. Other design criteria may be used solely at the discretion of the program administrator. Sufficient support material to document the methodology will be required (see appendix).
