Topic: 

A Resolution to Authorize the Execution of a Non-Disturbance Agreement with Midland Development Corporation:  T-Hangar #3, Unit #47, Warrenton-Fauquier Airport

 

Topic Description:

Midland Development Corporation leases land from the County for a 30-year period and has constructed T-Hangars on the leased property at the Warrenton-Fauquier Airport.  Prospective tenants considering a long-term lease of the hangar have requested some assurance that if the lease is terminated, the County as the new owner of the hangar would allow continued occupancy under terms similar to the current lease.  These terms require the tenant to pay for normal maintenance, utility, insurance and taxes associated with the hangar unit.  An annual management fee is also provided.  Under this contingency the County’s financial position is basically unimpacted as net revenue and expenses associated with the hangar are relatively the same if Midland or the County were to own the unit through the current lease term of 2036.

Requested Action of the Board of Supervisors: 

Consider adoption of the attached resolution.
