ORDINANCE

AN ORDINANCE TO APPROVE OPAL CREEK: A REQUEST TO REZONE APPROXIMATELY 13.07 ACRES OF LAND FROM RURAL AGRICULTURAL (RA) TO RESIDENTIAL (R-4) (REZN07-CR-003)

            WHEREAS, James W. Ward, Jr. and Judy W. Ward, Owners, and James W. Ward, Jr., Applicant, have submitted a proffered rezoning request (proffer statement dated December 11, 2007) (REZN07-CR-003) to rezone to approximately 13.07 acres of land from Rural Agricultural (RA) to Residential (R-4); and

WHEREAS the applicant seeks rezoning approval in order to allow for a 24-lot single family home residential subdivision; and

            WHEREAS, the parcel is within the Opal Service District; and

            WHEREAS, on October 25, 2007, the Fauquier County Planning Commission held a public hearing on the rezoning request and recommended that the application be approved; and

            WHEREAS, on December 13, 2007, the Fauquier County Board of Supervisors held a public hearing on this rezoning request and considered both oral and written testimony; and

            WHEREAS, the Board of Supervisors concurred with the judgment of the Planning Commission; and

            WHEREAS, by the adoption of this Ordinance the Board of Supervisors has determined that the public necessity, convenience, general welfare, or good zoning practice is satisfied by this amendment to the Fauquier County Zoning Map; now, therefore, be it

            ORDAINED by the Fauquier County Board of Supervisors this 13th day of December 2007, That the Rezoning request REZN07-CR-003, Opal Creek, to change the Zoning Map designation of 13.07 acres of RA zoned property to R-4 be, and is hereby, approved, subject to the Opal Creek Rezoning and Special Exception Plat, dated October 2, 2007, and the Proffer Statement as dated December 11, 2007.
