Topic:  A Resolution Denying the Pelham Village Special Exception (SPEX04-LE-001) to Cross and Disturb a Floodplain

 

Topic Description:

 

The applicant is requesting special exception approval to cross a floodplain with a road, and a variety of stormwater management facilities.  This application is directly associated with companion Pelham Village Comprehensive Plan Amendment (CPA03-L-07) and Rezoning applications (RZ03-L-10) from RA (Rural Agricultural) to PRD (Planned Residential District).

 

Please refer to the comprehensive staff report and analysis contained in the public hearing agenda item for the Pelham Village Comprehensive Plan Amendment and Rezoning applications.  This special exception application has been grouped with that hearing item.  Also note that in July of 2003, the Board of Supervisors approved the requisite floodplain crossing for Southcoate Village through this D.C. Diamond Corporation property to Route 28. 

 

The Special Exception (SPEX04-LE-001), currently proposed, has a stormwater management pond centered within the 100-year floodplain in a manner inconsistent with the Stormwater Management Ordinance, and the proposed Southcoate Village Drive extension near Route 28 in Pelham Village needs to avoid the floodplain.  The approved special exception avoids those two issues.

 

Requested Action of the Board of Supervisors:

Hold a public hearing, and consider adoption of the attached resolution.

 

Planning Commission Recommendations:

 

At its November 20, 2003 meeting, the Planning Commission recommended unanimously that the Pelham Village Comprehensive Plan Amendment, Rezoning and Special Exception application package be denied.

RESOLUTION

 

A RESOLUTION DENYING THE PELHAM VILLAGE SPECIAL EXCEPTION 
       (SPEX04-LE-001) TO CROSS AND DISTURB A FLOODPLAIN

 

WHEREAS, D.C. Diamond Corporation has applied to Fauquier County for a Comprehensive Plan Amendment, a special exception and a rezoning to create a subdivision known as Pelham Village between the Bealeton and Remington Service Districts; and

 

WHEREAS, in the months of August, September, October and November 2003, the Fauquier County Planning Commission held an extended public hearing on the referenced applications, including the companion special exception request; and

 

WHEREAS, the applicant indicated that the initial proposal would not be altered and requested the application be forwarded to the Board of Supervisors; and

 

WHEREAS, the stormwater management pond was centered within the 100-year floodplain in a manner inconsistent with the Stormwater Management Ordinance, and the proposed Southcoate Village Drive extension near Route 28 needs to avoid the floodplain; and

 

WHEREAS, on November 20, 2003, the Planning Commission forwarded the application with a recommendation of denial; and

 

WHEREAS, on December 15, 2003, the Fauquier County Board of Supervisors held a public hearing and concurred with the judgment of the Planning Commission; now, therefore be it

 

RESOLVED by the Fauquier County Board of Supervisors this 15th day of December 2003, That the Pelham Village Special Exception (SPEX04-LE-001) for a floodplain crossing and land disturbance be denied.
