(A law requiring the statewide recording of births and deaths was passed by the Virginia General Assembly on April 11, 1853 and continued until 1896 when legislation repealed the recording provisions. There are no birth and death records prior to 1853 and no records from 1897 to June 14, 1912, either at the county or state level. Those birth/death records which were recorded with the Clerk of Court were compiled by Commissioners of the various districts in each county and some of the records may not have reached the courthouse for filing.) The State began recording birth and death records after June 14, 1912. Some clerk’s offices may have duplicates of the state records. The state’s certification may be required if records are being used for official or passport purposes.


The cost of regular copies is $.50 per page. All birth and death copies must be certified and are $3 each. All marriage copies that are 50 years old to present must also be certified for a $3 fee. Marriages older than 50 years can be certified upon request.

All other certifications by request for deeds, wills....are $2 per document and $.50 per copied page.

Mail-in requests can be processed provided details are given to locate the requested information (needed: type of document, name, book and page reference). Please keep in mind that the staff cannot do real estate title searches. If you need the staff to perform a record search, there is a $5.00 fee per name/per search. Please provide the information above, along with a self-addressed, stamped envelope. In order to process your request on a timely basis, please send the appropriate size envelope with sufficient postage for return. We accept checks and money orders made payable to: Clerk, Circuit Court of Fauquier County.


  • Fauquier County was formed on May 1, 1759 from Prince William County.
  • Prince William County was formed in March 1731 from both Stafford and King George.
  • Stafford was formed in 1664 from Northumberland and King George was formed in April 1721 from Richmond.
  • Northumberland was formed in October 1648 from the Indian District Chickacoan.
  • Old Rappahannock was formed in December 1656 and passed out of existence 1692 originally from Lancaster.
  • Lancaster was formed in 1651-52 from Northumberland and York.
  • York was formed in 1642-43 and was one of the original shires.
