The Final Plat is the plat of subdivision that once recorded, will create the individual lots shown in the Preliminary Plat, Construction Plan, or Infrastructure Plan. Prior to submission of a Final Plat, a Construction Plan or Infrastructure Plan must be approved.

Final Plat Submission and Review Process

Prior to submission of a Final Plat application, a Construction Plan or Infrastructure Plan must be approved. For any application that involves public water or sewer, a Pre-Design meeting is required with the Fauquier County Water and Sanitation Authority (FCWSA). A.   First Submission Minimum Requirements:

      Additional Information that may be required:

  • A Deed of Easement may be required for Non-Common Open Space dedication where Section 2-406 of the Zoning Ordinance applies to the proposed subdivision.

  • A Deed of Ingress-Egress Easement may be required where private streets or access easements are proposed.

  • Does your application involve using an existing Private Road for access? If so, these additional requirements may apply. 

  • Verification of Fauquier County Health Department approval for all existing and proposed individual sanitary septic systems. See Sanitary Sewer and Water for required plat notes.

  • Draft Stormwater Management Maintenance Agreement and Schedule for review; see Stormwater Management for more information.

B.    Second Submission Requirements:

  • No submission fee is due with the Second Submission.

  • A typed comment response letter addressing each review agency’s comments individually, and detailing the plan revisions made. The number of letter copies submitted should equal the number of review agencies commenting.

  • A revised set of plats with changes highlighted on each copy. The number of plan copies submitted should equal the number of review agencies commenting, unless changes will affect other review agencies, plus one copy.

  • Deed of Subdivision, unsigned for review purposes.

  • Homeowners Association documents, to include a copy of all covenants and restrictions as applicable.

  • A copy of all required Deeds and Agreements as necessary, unsigned for review purposes.

  • Flash drive containing individual PDF copies of all re-submission materials and documentation.

C.   Third and Subsequent Submissions:

  • $400 Flat Fee due at the time of re-submission.

  • A typed comment response letter addressing each review agency’s comments individually, and detailing the plan revisions made. The number of letter copies submitted should equal the number of review agencies commenting.

  • A revised set of plans with changes highlighted on each copy. The number of plan copies submitted should equal the number of review agencies commenting, unless changes will affect other review agencies, plus one copy.

  • A revised copy of all required Deeds, Agreements and other documents as necessary, unsigned for review purposes.

  • Flash Drive containing individual PDF copies of all re-submission materials and documentation.  

D.   Signature Set Submission:

Once all required revisions have been made to the Final Plat of subdivision and all required Deeds and Agreements have been revised and approved, the plat will be ready for signature set submission.

  • No Fee due with signature set submission, unless other unpaid fees are outstanding.

  • Eight (8) copies of the approved version of the Final Plat must be provided to Community Development. One copy will be retained by the County, the remainder will be returned to the applicant for recording purposes. The Final Plat must be submitted to the County bearing all required signatures and notaries.

  • An original set of all required Deeds and Agreements, with owners’ original signatures.

  • Flash drive containing the approved version of the Final Plat and all required Deeds and Agreements.

Final Plat Approval for Recordation

The Final Plat will not be approved by the County until the following criteria are met: 

  • The Stormwater Management Maintenance Agreement has been recorded. See Stormwater Management for more information.

  • Improvements Bond has been submitted and accepted. See Bonding for more information.

  • All public utility Bonds have been posted with the separate agency, with proof of bonding provided.  

  • All sanitary septic systems have received the approval of the Health Department, with proof of approval provided.

  • The Homeowners Association has been created, with proof of creation provided.

  • All necessary Deeds and Agreements have been approved.

Once all necessary approval criteria have been met, the Final Plat of subdivision will be approved by the County. The approved plat copies will be made available to the applicant, and can be recorded in the Clerk’s Office, 1st Floor 29 Ashby Street.

Final Plat Expiration

County approval of the Final Plat is valid for a period of six months. After six months past the County approval signature date, the plat can no longer be recorded unless an extension is approved by the County. The applicant must submit a written extension request and justification for County review and decision. For more information, refer to Section 10-9 of the Subdivision Ordinance. Please note that an approved Construction Plan, Infrastructure Plan, and/or Preliminary Plat for the development must be within that plan’s respective valid period when the Final Plat is recorded.
