Land Disturbing Permit with an Agreement In Lieu of a Plan

SINGLE FAMILY RESIDENCE 

Construction of a single-family dwelling unit requires approval of a land disturbing permit prior to issuance of a zoning/building permit for a home if more than 10,000 square feet is being disturbed.  

An “Agreement In Lieu of a Plan” is a contract between the VESMP authority (the County) and the owner that specifies erosion and sediment control measures that must be implemented and maintained during the construction of a single-family residence.  

Submission Requirements 

  • Site Sketch (aerial, plat or drawing can be used) 

  • Show all proposed disturbances associated with the single-family residence (residence, septic system and drainfield, entrances, driveways, re-graded areas around foundation and yard) 

FARM BUILDING OR STRUCTURE 

Construction of a farm building or structure requires approval of a land disturbing permit prior to issuance of a zoning/building permit if more than 10,000 square feet is being disturbed. 

An “Agreement In Lieu of a Plan” is a contract between the VESMP authority (the County) and the owner that specifies erosion and sediment control measures that must implemented and maintained during the construction of the farm building or structure. The “Agreement In Lieu” is only applicable where the construction of the farm building or structure will result in a total impervious cover percentage, including the impervious cover from the farm building or structure to be constructed, of less than 5% of the parcel of land. If the construction will result in a total impervious cover percentage that is or will be greater than or equal to 5% of the total parcel of land, an “Agreement In Lieu” is not applicable.  

Submission Requirements 

  • Site Sketch (aerial, plat or drawing can be used) 

  • Show all proposed disturbances and impervious area associated with the property (existing and proposed building areas, roads, driveways, and parking areas regardless of agriculture activity exemption or not) 

Although a plan is not required in the above instances, additional information may be required in certain circumstances and must be submitted as described in the applications.
