The Code of Virginia states that real estate that is at least three years tax delinquent is eligible for tax sale through an order of the Circuit Court (§§ 58.1-3965, et seq.). There are no tax sales of personal property: vehicles, farm equipment, etc. Tax sales are held periodically without any regularity.

When scheduled, notice of the tax sale will be posted on the Fauquier County Treasurer's Office Judicial Tax Sale webpage along with information about each property.
